These Partner Terms of Use govern applications to become a FESTENO Partner and use of the FESTENO partner workspace, including profiles, service areas, categories, availability, opportunities, proposals, credits, and support.
FESTENO is operated by VIVAMAIS MULTISSERVICOS LTDA, São Paulo, SP, Brazil. By applying, accessing Partner Services, or accepting an opportunity, you agree to these Terms and the Privacy Policy.
1. Eligibility and application
You confirm that you can contract, have authority to represent the business or professional profile submitted, and will provide accurate, current, lawful information. Keep your categories, service areas, availability and profile information accurate. An application does not create employment, agency, exclusivity, or a right to receive opportunities. FESTENO may approve, decline, pause, or remove a profile to protect users, comply with law, or preserve platform quality and safety.
2. Independent professional relationship
Partners are independent businesses or professionals, not employees, agents, representatives, or joint venturers of FESTENO. You are solely responsible for services, personnel, equipment, licenses, permits, taxes, insurance, contracts, fulfillment, safety, and compliance.
3. Opportunities, proposals, and confidentiality
An opportunity is not a guarantee of selection, booking, payment, or Customer identity. Proposals must be accurate, lawful, professional, and capable of delivery. Customer, brief, proposal, and platform information that is non-public must be kept confidential and used only through FESTENO. You must not identify, contact, solicit, or transact with a Customer outside the authorized FESTENO process using information obtained through the Partner Services.
4. Credits and paid features
Where credits or paid features are offered, applicable price, quantity, and terms are displayed before purchase. Credits are platform units, not currency, a deposit account, stored value, or a security; they have no cash value and are not transferable or redeemable for cash except where FESTENO expressly permits. A purchase does not guarantee an opportunity, selection, booking, revenue, or Customer response. No payment is processed without your affirmative purchase action.
5. Profile and materials
You retain ownership of submitted materials and grant FESTENO a non-exclusive, worldwide, royalty-free license to host, format, display, and use them as needed to operate, market, secure, and improve the Partner Services. You confirm you have all necessary rights and permissions.
6. Acceptable use
You may not submit misleading information; bypass platform, credit, or security controls; scrape data or use unauthorized automation; introduce harmful code; disclose non-public information; or use the services unlawfully, fraudulently, discriminatorily, abusively, or in violation of rights.
7. Support and communications
The Partner workspace is the authoritative location for the status of a support request. Support communications and notifications may be limited as necessary to protect privacy, confidentiality, and platform security.
8. Suspension and termination
FESTENO may suspend, limit, or terminate access where reasonably necessary to protect Customers, Partners, FESTENO, or platform integrity, including for suspected breach, fraud, safety, or legal compliance. Termination does not erase obligations that continue by their nature, including confidentiality, payment, intellectual-property, dispute, and legal-compliance obligations.
9. Disclaimers and liability
The Partner Services are provided on an “as available” basis. To the maximum extent permitted by law, FESTENO does not guarantee opportunity volume, selection, payment, bookings, or outcomes, and is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Nothing limits liability that cannot lawfully be limited.
10. Changes, law, and contact
We may update these Terms and post the effective date. These Terms are governed by Brazilian law, and disputes are submitted to the courts of São Paulo, SP, Brazil. Questions: info@festeno.com.
